Shastho AI provides services that allow patients to access hospitals, clinics, medical practitioners, and healthcare providers; purchase Shastho Cards for discounts at partner hospitals and clinics; make appointments for themselves and others; schedule medical tests; view medical reports; and access medical history and related healthcare information through the Shastho AI website and mobile application (the "Shastho AI platform"). These services operate under the Shastho AI brand and are provided by Shastho Limited, a company registered under the laws of Bangladesh ("Shastho AI").

These Terms of Use govern your use of our service. In these Terms of Use, "Shastho AI Service," "our Service," or "the Service" means all services available on the Shastho AI platform.

These Terms govern your access to and use of https://app.shastho.ai and the Shastho AI mobile application on Android and iOS devices.

Acceptance

By accessing or using our Services, you agree to these Terms in full. If you do not agree to any part of these Terms, you must not use our Services.

2. Except for the limited permissions granted by these Terms, no right, title, license, or interest is granted to you in relation to the Services or the content and materials that are part of the Services.
License to Use Website and Service
1. You may use Shastho AI to book appointments for yourself and up to five (05) other patients ("Co-patients") from your profile. You will receive an OTP when requesting an appointment, and you will be notified once your appointment is confirmed. You will be able to check your progress and your Co-patients' progress, and maintain generated prescriptions and diagnostic test reports.
2. You may view your own profile, your Co-patients' profiles, and the profiles of hospitals, clinics, healthcare centers, doctors, and healthcare professionals through our Website in a web browser, except as restricted by these Terms.
3. You are responsible for providing complete and accurate information, including your full name, address, home telephone number, mobile number, date of birth, and the corresponding information for any Co-patients.
4. Your privacy and the privacy of your Co-patients will be maintained in care discussions, examinations, treatments, and medical records. You will be notified if a hospital, clinic, healthcare center, doctor, healthcare professional, or other person attempts to access information or materials from your profile or a Co-patient's profile through our Website, where such notice is applicable.
5. You may cancel appointments, diagnostic tests, and related bookings at any time by informing the relevant hospital, clinic, or healthcare provider. To cancel through Shastho AI, follow the cancellation instructions on the platform.
6. We reserve the right to restrict access to any area of our Website or Service, or to the whole Website or Service, at any time and for any reason, at our sole discretion. You must not circumvent, bypass, or attempt to circumvent or bypass any access restriction measures on our Website or Service.
Restrictions on Use
1. You may not use our Website or app in any way, or take any action, that causes or may cause damage to the Website or app, or that impairs the performance, availability, or accessibility of the Website or app.
2. You may not use our Website or app in any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
3. You must ensure that all information you supply to us through our Website or app, or in relation to our Website or app, is true, accurate, current, complete, clear, and not misleading.
Shastho AI Service
1. You must be at least 18 years old, or the age of majority in your province, territory, country, or jurisdiction, to become a member of the Shastho AI Service. Minors may use the Service only under the supervision of an adult.
2. Shastho AI may make changes to the Service, including the services available. We also continually test aspects of our Service, including our Website, user interfaces, promotional features, and availability of Shastho AI content.
3. You agree to use the Shastho AI Service, including all features and functionality, in accordance with all applicable laws, rules, regulations, and other restrictions on use of the Service.
4. We may terminate or restrict your use of our Service if you violate these Terms of Use or engage in illegal or fraudulent use of the Service.
5. The display quality of the Shastho AI Service may vary from device to device and may be affected by factors such as your location, available bandwidth, and internet connection speed.
Account Creation and Access
1. You can create a Shastho AI account for yourself or your Co-patients by signing up with an email address or mobile number. Shastho AI will create an account based on the login information you provide. Once the account is created, you will be able to access the available Services.
2. To maintain control over the account and prevent unauthorized access to medical information, you should maintain control over the devices used to access the Service and should not disclose your password or payment details to anyone.
3. You are responsible for updating and maintaining the accuracy of the information you provide to us in relation to your account. We may terminate or place your account on hold to protect you, your Co-patients, Shastho AI, or our hospital, clinic, and healthcare center partners from identity theft or other fraudulent activity.
Payment Methods
1. You may use Shastho AI to pay for your own and your Co-patients' doctor appointments, diagnostic tests, and related services through direct payment to the selected hospital, clinic, or healthcare center via PortWallet, a payment gateway service. 2. You can purchase a Shastho Card directly from Shastho AI. The price of the Shastho Card depends on the selected plan, as described on the Pricing Page. Shastho AI has sole discretion to determine pricing and reserves the right to change or modify pricing periodically.
Warranties
The Shastho AI Service is provided "as is" and without warranty or condition. In particular, our Service may not be uninterrupted or error-free. To the fullest extent permitted by law, you waive all claims for special, indirect, and consequential damages against us.
Indemnification
By agreeing to these Terms, you agree to defend, indemnify, and hold harmless Shastho AI, its licensors, parent organizations, subsidiaries, affiliates, officers, directors, members, employees, attorneys, and agents from and against any and all claims, costs, damages, losses, liabilities, and expenses, including lawyers' fees and costs, arising out of or in connection with: (a) your violation or breach of these Terms or any applicable law or regulation, including any local laws or ordinances, whether or not referenced herein; and (b) your use or misuse of the Services.
Internet Delays
The Services, Website, and software may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. These may include issues caused by your device being faulty, not connected, out of range, switched off, or otherwise not functioning. We are not responsible for delays, delivery failures, damages, or losses resulting from such problems.

1. Governing Law
  These Terms of Use shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh.
2. Unsolicited Materials
  Shastho AI does not accept unsolicited materials or ideas for Shastho AI content and is not responsible for any similarity between its content or programming, in any media, and materials or ideas transmitted to Shastho AI.
3. Customer Support
  To find more information about our Service and its features, or if you need assistance with your account, please visit the Shastho AI website.
4. Survival
  If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.
5. Changes to Terms of Use and Assignment
  1. Shastho AI may change these Terms of Use from time to time. Although we may attempt to notify you when major changes are made, you should periodically review the most up-to-date version. We may, at our sole discretion, modify or revise these Terms of Service and related policies at any time, and you agree to be bound by such modifications, revisions, or updates. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits.
  2. Where required, we will notify you at least 30 days before new Terms of Use apply to you.
6. Electronic Communications
  We will send you information relating to your account, such as payment authorizations, invoices, password or payment-method changes, confirmation messages, notices, and OTPs, in electronic form only. This may include SMS sent to your phone number or emails sent to the email address provided during registration and updated in your profile.
7. Legal Action
  Without prejudice to any other right available to Shastho AI under these Terms, law, or equity, Shastho AI reserves the right to take legal action against you for any breach of these Terms.
